• Website and landing page development
• Lead generation campaigns
• All services are provided in accordance with individual client agreements or project proposals, which outline specific deliverables, timelines, and commercial terms.
• Eligibility
By using our services, you confirm that you are at least 18 years of age and are legally eligible to enter into a binding contract.
• Client Responsibilities
Clients are expected to:
Provide accurate and timely information, content, and necessary approvals.
Ensure compliance with all applicable laws, including but not limited to DLT regulations, data protection laws, and advertising guidelines.
Review and approve campaign elements within agreed timelines to avoid project delays.
• Campaign Performance
While we strive to deliver optimal results, MDS Digital Media Pvt. Ltd. does not guarantee specific performance outcomes such as leads, traffic, sales, or search engine rankings unless explicitly documented in writing.
• Intellectual Property
All marketing materials, creatives, and digital assets created by us remain the intellectual property of MDS Digital Media Pvt. Ltd. until full and final payment is received.
Clients retain ownership of their own brand assets, data, and intellectual property shared with us.
• Confidentiality
Both parties agree to maintain the confidentiality of all proprietary or sensitive information shared during the engagement. Such information shall not be disclosed to any third party without prior written consent, unless required by law.
• Limitation of Liability
MDS Digital Media Pvt. Ltd. shall not be held liable for:
Indirect, incidental, or consequential damages
Delays or failures caused by third-party platforms or technical disruptions beyond our control
Loss of data, revenue, or business arising from the use of our services
• Use of Third-Party Platforms
Our services may involve the use of third-party tools and platforms such as Google Ads, Meta (Facebook/Instagram), SMS gateways, or hosting services. We are not responsible for any changes, outages, or limitations imposed by these platforms.
• Termination of Services
Either party may terminate the engagement with a written notice of 15 days. Upon termination, all outstanding dues must be cleared. MDS Digital Media Pvt. Ltd. reserves the right to suspend or terminate services immediately in case of breach of these Terms or applicable laws.
• Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
• Updates to Terms
We reserve the right to revise these Terms at any time without prior notice. The most current version will always be available on our website. Continued use of our services after such revisions shall constitute your consent to the updated Terms.
